Welcome to Aapka Munshi. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.

1. Acceptance of Terms

By accessing or using Aapka Munshi's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.

2. Service Description

Aapka Munshi provides the following services:

  • Web Dashboard -A browser-based interface for searching, tracking, and managing court cases from the eCourts system
  • WhatsApp AI Assistant -An intelligent chatbot that provides case information, updates, and assistance via WhatsApp
  • Case Tracking & Alerts -Automated notifications for hearing dates, case status changes, and related updates
  • Google Calendar Sync -Synchronisation of hearing dates to your Google Calendar
  • Google Drive Storage -Storage of case-related documents in your Google Drive

3. Account Requirements

To use our services, you must:

  • Be at least 18 years of age
  • Sign in using a valid Google account
  • Link and verify a WhatsApp phone number to access the WhatsApp AI assistant
  • Provide accurate and complete information

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access to your account.

4. Google Account Integration

Our service integrates with your Google account to provide the following features:

  • Google Calendar -We request permission to create, update, and delete calendar events. This is used exclusively to sync your hearing dates as calendar events. We do not read or modify any other events in your calendar.
  • Google Drive -We request permission to create files and folders. This is used exclusively to store case-related documents. We can only access files and folders that our application has created.

You may revoke these permissions at any time by visiting Google Account Settings. Revoking permissions will disable the corresponding sync features but will not affect your ability to use other parts of the service.

Your Google data is handled in accordance with the Google API Services User Data Policy, including the Limited Use requirements. For full details on how we handle your Google data, please refer to our Privacy Policy.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Scrape, crawl, or use automated means to extract data from our platform beyond normal use
  • Impersonate another person or entity
  • Interfere with or disrupt the integrity or performance of the service
  • Use the AI assistant to generate, store, or transmit content that is harmful, abusive, or illegal
  • Reverse-engineer, decompile, or disassemble any part of our service

6. Data and Privacy

Your use of our service is governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using our service, you consent to the data practices described in the Privacy Policy.

Information received from Google APIs is handled in accordance with the Google API Services User Data Policy, including the Limited Use requirements.

7. eCourts Data Disclaimer

Case information displayed on Aapka Munshi is sourced from the eCourts platform operated by the Government of India. We act as an intermediary to present this publicly available data in a more accessible format.

Important:

  • We do not guarantee the accuracy, completeness, or timeliness of court case data
  • Data may be delayed, incomplete, or temporarily unavailable due to eCourts system limitations
  • Always verify critical case information directly with the relevant court
  • We are not responsible for any errors or omissions in data sourced from eCourts

8. AI Assistant Disclaimer

The Aapka Munshi AI assistant does not provide legal advice.

The AI assistant is designed to help you look up case information, manage tracked cases, and answer general queries about the eCourts data. Its responses are generated by an artificial intelligence model and should not be treated as legal advice, legal opinion, or a substitute for professional legal counsel.

Always consult a qualified advocate or legal professional for matters requiring legal advice. We disclaim all liability for actions taken based on information provided by the AI assistant.

9. Intellectual Property

The Aapka Munshi name, logo, website design, and software are our intellectual property or that of our licensors. You may not copy, modify, distribute, or create derivative works from any part of our service without prior written consent.

Court case data sourced from eCourts is publicly available government information. We do not claim ownership over such data.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Aapka Munshi and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss arising from reliance on case data or AI-generated responses
  • Missed hearing dates due to notification or sync failures
  • Inaccurate or outdated case information from eCourts
  • Unauthorised access to your account
  • Service interruptions or downtime
  • Loss of data stored in Google Calendar or Google Drive as a result of using our service

Our total aggregate liability for any claim arising from or related to the service shall not exceed the amount you have paid us in the twelve months preceding the claim, or INR 1,000, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aapka Munshi, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your violation of any rights of a third party.

12. Account Termination

You may stop using our service at any time. You may request account deletion by contacting us at hello@lexolegal.com.

We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or if we are required to do so by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary to protect the safety of our users or the integrity of our service.

Upon account termination:

  • Your OAuth tokens are cleared immediately, disabling all Google Calendar and Drive sync features
  • Your account data is deleted in accordance with our Data Retention policy
  • Calendar events and Drive files previously created in your Google account will remain there -we do not delete data from your Google account upon termination

13. Changes to These Terms

We may modify these Terms of Service from time to time. Material changes will be communicated via WhatsApp notification or a notice on our website at least 15 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the service.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at hello@lexolegal.com. We will endeavour to resolve disputes within 30 days of receiving your written complaint.
